The murder of investigative reporter, Daphne Caruana Galizia on October 16, 2017 was a wake-up call to the EU for the need to provide better protections for those who expose wrongdoing. (https://www.youtube.com/watch?v=oTGD1oxtgEs). At the time of her death, Galizia had more than 40 libel lawsuits pending against her for exposing high level corruption in Malta. She was on the way to the bank to try to un-freeze her assets when a car bomb was detonated killing her immediately. By April 2018, Maltese MEP Roberta Metsola and others began calling for the EU to adopt Anti-SLAPP protections (https://www.eppgroup.eu/how-we-make-it-happen/with-eu-countries/malta/news/measures-to-protect-media-needed). The Coalition Against SLAPPS in Europe (CASE) comprised of more than 50 NGO’s throughout the country was formed and began advocating for an EU-wide Anti-SLAPP Directive (https://www.the-case.eu/). On April 27, 2022, the European Commission issued a Model Anti-SLAPP Directive and Recommendations to Member States (https://ipi.media/eu-anti-slapp-directive-a-landmark-step-in-the-right-direction/). The next step is for the European Parliament and the Council of Europe to engage on the initiative and build on the Commission’s legislative proposal for implementation.
